OFFICIAL RULES
NO PURCHASE NECESSARY.
CONTEST: The Electric Cooperative Youth Tour Video Contest (the “Contest”) begins
at 12:00 a.m. Central Time on September 1, 2011, and ends at 11:59 p.m. Central
Time on February 1, 2012. At the conclusion of the Contest, the Judge Panel (defined
below) will select four (4) winners.
TO ENTER: To enter, go to www.gvec.org (the “Entry
Site”) and follow the online submission process under the Youth Tour Apply Here
icon which will require the Entrant (defined below) to provide their full name,
valid email address, daytime, telephone number, name of high school, parent(s)/legal
guardian’s name with Guadalupe Valley Electric Cooperative, Inc. (“GVEC”) electric
accounts and phone number, GVEC account number. If it is a group submission, one
member of the group must be designated as the Entrant (the “Primary Entrant”). Entrants
will be asked to review and accept these Official Rules and then will be able to
post a video to the Entry Site (a “Submission”).
ELIGIBILITY: Legal residents of the State of Texas who have parent(s)/legal guardians
with active accounts for electric service with GVEC, and are sophomores, juniors
or seniors in high school for the 2011-2012 school year at time of entry are eligible
to enter, except the children of directors and employees of GVEC or previous winners
of Prizes relating to the Contest held in prior years, and any other organizations
affiliated with the sponsorship, fulfillment, administration, prize support, advertisement
or promotion of the Contest and/or their respective agents, affiliates, subsidiaries
and members of their immediate families or household members. “Immediate family
members” means parents, step-parents, children, step-children, siblings, step-siblings,
or spouses. “Household members” means people who share the same residence at least
three months a year.
ENTRIES: Multiple entries are NOT allowed. Each Submission must meet the following
requirements:
· Each Submission must be 1-3 minutes (submissions that exceed 3 minutes will not
be considered).
· Entrants will be required to review, and agree to these Official Rules as outlined
on the Entry Site.
· After agreeing to these Official Rules on the Entry Site, the Entrant will be
required to enter his/her full name, valid email address, daytime, telephone number,
name of high school, parent(s)/legal guardian’s name with GVEC electric accounts,
GVEC account number and parents phone number.
· Each Submission will be tied to one Entrant. In the event that a group of students
(more than one) work together on a submission, the submission will be entered under
the name of a Primary Entrant. In the event that a Submission created by a group
(and submitted by a Primary Entrant) is declared the winner in accordance with these
Official Rules, the Prize will be awarded to the Primary Entrant.
· Only one prize will be given for each of the four (4) winners in accordance with
the section entitled “Winner Selection” below.
· The Submission must be the Entrant’s own original work; created by the Entrant;
must not have been previously published, released or distributed in any form; must
not have won any award; and must not infringe the copyright, trademark, privacy,
publicity, or other personal or proprietary rights of any person or entity.
· Music used in the submission must be original and/or not require any additional
clearances for the GVEC to use or post on public websites or to use in public forums
of any kind.
· The Submission must not contain or reference any names, products or services of
any third party company or entity or any third party trademarks, logos, trade dress
or promotion of any brand, product or service.
· The Submission must contain the Guadalupe Valley Electric Cooperative name.
· If any persons appear or are referred to in the Submission, Entrant is solely
responsible for obtaining consent from such persons prior to Entrant’s Submission.
A Submission will represent any required clearances have been received by Entrant.
In the event where clearances are not covered, the Submission will be disqualified
from the competition.
· Submissions that are lewd, obscene, sexually explicit, pornographic, disparaging,
defamatory, libelous, or Submissions that otherwise contain inappropriate content
or objectionable material, as determined in the Judge Panel’s sole and absolute
discretion, may not be submitted and may be removed at any time in GVEC’s sole and
unfettered discretion.
· The Submission must not contain any personally identifiable information of any
person other than the Entrant. Should the Submission include personally identifiable
information about the Entrant in the Submission, Entrant acknowledges and agrees
that such information will be disclosed publicly and Entrant assumes sole responsibility
for any consequences thereof.
· Entrant may not be, nor may Entrant work with parties in conjunction with the
Submission who are, (i) represented under contract (e.g., by a talent agent or manager)
that would limit or impair GVEC’s ability to display the Submission in any media
form; (ii) subject to an acting or modeling contract that would make their appearance
in the Submission a violation of any third-party rights; or (iii) under any other
contractual relationship, including but not limited to guild and/or union memberships,
that may prevent GVEC from being able to use the Submission worldwide in all media
in perpetuity on a royalty-free basis, without any attribution, payment or fee obligations.
· By entering the Submission, Entrant represents to Sponsor that he/she has parental
consent to participate in the Contest.
GVEC reserves the right in its sole and unfettered discretion to disqualify any
Submission that it believes violates or potentially violates any of the foregoing
requirements or otherwise fails to comply with any provision of these Official Rules
for the Entry Site. The decisions of GVEC on this and all matters pertaining to
the Contest are final.
PRIZE: Four (4) winners (each a “Winner”) will receive an all-expense paid trip
to The Electric Cooperative Youth Tour in Washington D.C. to be held June 14-22,
2012 for Winner (the “Prize”). The
Prize cannot be redeemed for cash. The Prize includes round-trip ground transportation
from GVEC’s principal office to Dallas, Texas and round trip coach air transportation
from Dallas to Washington D.C., standard quad-occupancy hotel accommodations (one
(1) room), and one (1) ticket to The Electric Cooperative Youth Tour. Trip must
be taken on dates specified by GVEC through the travel and hotel accommodations
arranged by GVEC or the Prize will be forfeited and, at GVEC’s discretion and time
permitting, an alternate Winner may be selected from among all remaining eligible
entries. A chaperone for the Winner will be provided by GVEC or its designee. Prize
details are at GVEC’s sole discretion. Tickets are subject to certain terms and
conditions specified thereon. Each Winner is responsible for all income taxes, luggage
fees in excess of one carry on and one checked bag and other costs associated with
Prize acceptance and use not specified herein as being provided, including, but
not limited to, souvenirs. No transfer, assignment, cash redemption, or substitution
of Prize (or portion thereof) permitted except by GVEC who may substitute a Prize
(or portion thereof) with a Prize of comparable or greater value. Prizes must be
accepted as awarded and no cash equivalent is available. The Prizes are neither
refundable nor transferable.
ESTIMATED ODDS: The odds of winning depend on the number of Submissions received.
There will be four (4) Winners.
FINALISTS SELECTION: GVEC will select ten (10) semifinalists (each a “Finalist”)
from the properly submitted Submissions by February 15, 2012 and notify each Finalist
via phone. Selections will be based on creativity, peer appeal, message clarity,
and information accuracy.
WINNER SELECTION: Each Finalist will be scheduled to be interviewed by a panel of
judges created by GVEC (the “Judge Panel”) at a date and time solely determined
by the Judge Panel. Failure of a Finalist to participate in the scheduled interview
shall result in a disqualification of the Submission. After the Judge Panel interviews
the Finalists and on or about March 1, 2012, the Judge Panel will select four (4)
Winners to receive the Prize and notify such Winners via phone. Upon notification
from GVEC, each Winner will have ten (10) business days to provide GVEC with a complete
(i) Parent’s Consent & Release Form, (ii) Expectations & Guidelines, (iii)
Consent for Medical Treatment, Liability & Publicity Release Form, and Personal
Profile Form. If the Finalist fails to respond with the information detailed above
within ten (10) business days of notification, GVEC shall disqualify the Submission
as a Winner, and another Submission may be selected as a Winner for the Prize.
CONDITIONS/WARRANTIES: Entrants agree to be bound by these Official Rules and agree
that if any Winner fails to provide proof of identity, refuses to provide required
documentation, is found to have violated the Official Rules or otherwise does not
meet eligibility criteria, the Prize will be forfeited and may be awarded to a subsequent
Winner. Entrants understand that GVEC is not liable for injuries, losses or damages
of any kind arising from participation in this Contest and acceptance, possession
and use of the Prize. GVEC is not responsible for any typographical or other error
in the printing of the offer, administration of the Contest or in the announcement
of the Finalists or Prize. Decisions of GVEC are final and binding in all respects.
GVEC assumes no responsibility for Submissions it is unable to process due to network,
hardware or other technical failures, or any other reason, or for incomplete, damaged,
misdirected, illegible, stolen or lost Submissions. GVEC reserves the right, in
its sole discretion, to modify the terms and conditions of the Contest, disqualify
any person tampering with the entry process, the operation of the Entry Site or
otherwise in violation of these Official Rules. GVEC further reserves the right,
in its sole discretion, to cancel, terminate or modify this Contest, in its sole
discretion, if not capable of completion as planned, including infection by computer
virus, technical corruption, non-authorized human intervention or any other causes
beyond GVEC’s control which corrupt or affect the administration, security, fairness,
or integrity of the Contest. In the event of cancellation, GVEC reserves the right
to select finalists and/or Winners from among all eligible entries received prior
to date of cancellation.
By submitting entry materials, Entrants acknowledge that they understand and agree
that the Released Parties’ (defined below) use of material containing features and
elements similar to or identical with those contained in Entrants’ entry materials
does not entitle Entrants to any compensation. By entering, Entrants waive any right
of action against the Released Parties in connection with the Released Parties’
use of any material (or any part thereof), whether or not the material contains
features or elements similar or identical to those contained in Entrants’ entry
materials. Entrants acknowledge and agree that GVEC will be under no obligation
to return any Submission or secure, maintain in secrecy or destroy any materials
provided in connection with the Contest.
PRIVACY: The GVEC will be collecting email addresses, and will also receive personally
identifiable information and other data concerning Entrants when they enter the
Contest. That information may be shared by GVEC with its affiliates, and may be
used by GVEC and its affiliates for marketing purposes (until a reasonable time
after Entrant exercises an opt-out option for any given company as stated in any
marketing email or as stated in the company’s “privacy and security” statement).
In other respects, information obtained concerning participants will be subject
to the “privacy and security” statements available via links from
http://www.gvec.org/privacyPolicy.aspx.
LIMITATION OF LIABILITY: GVEC, its affiliates, subsidiaries and their respective
agents, employees, directors or officers (the “Released Parties”) assume no responsibility
for any error, omission, interruption, deletion, defect, delay in operation or transmission,
communications line failure, theft or destruction or unauthorized access to, or
alteration of, entries. GVEC is not responsible for any problems or technical malfunction
of any telephone network, telephone lines, computer on-line systems, servers, providers,
hardware, software or failure of any email or entry to be received by GVEC on account
of technical problems, human error or traffic congestion on the Internet or at any
website, lost or unavailable network connections, fraud, incomplete, garbled or
delayed transmissions, or any combination thereof, including (i) any injury or damage
to any Entrant’s or any other person’s computer relating to or resulting from participation
in the Contest or downloading or uploading any materials relating to the Contest,
or (ii) any restriction or impedance on an Entrant’s ability to participate in the
Contest.
GVEC is not responsible for any incorrect Entrant attribution or credit, or any
incorrect use, omission or reproduction of entry materials.
BY ENTERING THE CONTEST, EACH ENTRANT RELEASES AND HOLDS HARMLESS THE RELEASED PARTIES
FROM ANY AND ALL LIABILITIES, INJURIES, CLAIMS, LOSSES, DAMAGES OR EXPENSES OF ANY
KIND ARISING FROM OR IN CONNECTION WITH THE CONTEST OR ACCEPTANCE OR USE OF ANY
PRIZE WON. EACH WINNER AGREES THAT THE RELEASED PARTIES ARE NOT LIABLE WHATSOEVER
FOR INJURY, DAMAGE, EXPENSE, INTELLECTUAL PROPERTY INFRINGEMENT, ACCIDENT, DELAY,
IRREGULARITIES, LOSS OR CLAIM CAUSED OR CLAIMED TO BE CAUSED, DIRECTLY OR INDIRECTLY,
BY PARTICIPATION IN THE CONTEST, OR BY THE ACCEPTANCE, POSSESSION, USE OR MISUSE
OF ANY PRIZE AWARDED. THE FOREGOING RELEASES SHALL APPLY REGARDLESS OF WHETHER OR
TO WHAT EXTENT THE RELEASED PARTIES MAY BE NEGLIGENT.
Any and all claims, judgments and awards shall be limited to reasonable actual out
of pocket costs incurred, including costs associated with entering the Contest,
but in no event shall ANY entrant be entitled to attorneys’ fees. Under no circumstances
will ANY entrant be permitted to obtain awards for, and EACH entrant hereby waiveS
all rights of claim to punitive, incidental and consequential damages and any other
damages, other than for reasonable actual out-of-pocket expenses, and any and all
rights to have damages multiplied or otherwise increased.
GVEC DISCLAIMS ANY AND ALL IMPLIED WARRANTIES WITH RESPECT TO THE CONTEST, AND THE
PRIZE, INCLUDING WITHOUT LIMITATION ANY WARRANTY OR MERCHANTABILITY OR FITNESS FOR
A PARTICULAR PURPOSE.
DISPUTE RESOLUTION: GVEC’s decisions as to all matters related to the administration
of the Contest and selection of the Winners are final, and by entering the Contest,
each Entrant agrees to abide by these Officials Rules and all of GVEC’s decisions.
Entrant agrees that any and all disputes, claims and causes of action arising out
of or connected with this Contest, or any Prizes awarded, other than the administration
of the Contest or the determination of Winners, shall be resolved individually,
without resort to any form of class action, and exclusively by the federal and state
courts located in Gonzalez County, Texas (unless a Texas mandatory venue statute
applies, in which case the mandatory venue shall be the exclusive forum for disputes).
By participating in the Contest, each Entrant consents to the personal jurisdiction
of such courts and waive any and all objections thereto.
USE OF NAME AND LIKENESS: Regardless of whether a Winner of the Contest, each Entrant
irrevocably authorizes the Released Parties to use, copy, publish, distribute, modify
and otherwise freely exploit and commercialize his or her name, voice, likeness,
biographical data, city and state of residence and entry materials, whether in whole
or in part, in any and all media now known or hereafter discovered (including without
limitation on www.gvec.org, and The GVEC Review local pages within Texas Co-op
Power magazine), for any purpose, including without limitation, in connection
with, and to promote, market or advertise, the Contest and GVEC, in whole or in
part, without review, approval, credit or attribution, notification or payment from
or to Entrant or any person or entity, worldwide, in perpetuity, or on a Winner’s
list, if applicable, unless prohibited by law. GVEC is not obligated to use any
of the above-mentioned information or materials, but may do so and may edit such
information or materials, at GVEC’s sole discretion, without further obligation
or compensation.
Each Winner agrees to make a reasonable number of statements and appearances in
person, by audio, and/or video for future Electric Cooperative Youth Tour promotions
as reasonably requested by GVEC without the right to any compensation other than
the Prize which such Winner has won.
GRANT OF RIGHTS: All Entrants grant GVEC the right to display their Submissions
at the Entry Site or otherwise for purposes of this Contest although this will have
no impact on determining the eligible Winners in this Contest. Finalists further
grant GVEC the right to display their Submissions on third party sites such as youtube.com,
facebook.com, twitter.com and gvec.org for promotional purposes. Winners hereby
grant GVEC an exclusive, royalty free license, without geographic or time limitation,
to display, whether in whole or in part, or create derivative works based on such
Winner’s Submission for promotional or advertising related purposes in any and all
media. The use of the Submissions after the Contest is complete for advertising
and promotional purposes may or may not include the Entrant’s name and city and
state of residency. Winners agree to sign any documents that may be necessary to
affect the assignment of the licensing rights.
SEVERABILITY: If any provision(s) of these Official Rules are held to be invalid
or unenforceable, all remaining provisions hereof will remain in full force and
effect.
LANGUAGE DISCREPANCY: In the event of any discrepancy or inconsistency between the
terms and conditions of these Official Rules and any Contest related materials,
including but not limited to the Contest entry form, any television, point of sale,
print or on-line advertising, the terms and conditions of these Official Rules shall
prevail, govern and control.

the names of the Winners (if and when the names of the Winners are announced by
